When a criminal pleads guilty or is convicted, the judge will then have to decide the correct sentence for the criminal conduct in the sentencing process. In some criminal cases, the judge has the power to decrease or raise the punishments based on the presented unique factors of the defendant and the offense. In most cases, the judges have the discretion to determine the suitable sentence, and from incarceration to diversion, they have plenty of sentencing options to choose from (Tata, 2019).
