Due to reduced social stigma in modern society, more LGBTQ individuals are coming out earlier in life (Gates, 2015). As a result, LGBTQ students today in Louisiana are more likely than their counterparts from past generations to be open about their sexual orientation and gender identity. The more LGBTQ students, the more likely they are to be discriminated against in schools based on their sexual orientation and gender identity. This paper will analyze the legal landscape and determine what legal protections are available to LGBT students in Louisiana.
At first, Louisiana law protects all students in general from school bullying, and its provisions require that every school must adopt and enforce a policy prohibiting the bullying of students by other students (Bullard, 2020). However, these laws do not entail any enumerated protections for LGBTQ students are not protected; thus, they are still vulnerable to bullying, discrimination, and stigmatization by their fellow students, teachers, and school administrators. Additionally, Louisiana is among the states that have enacted the “Don’t Say Gay” regulations in school that are stains teachers from discussing issues relating to LGBTQ, including HIV/AIDS awareness and sexual health in the classroom (Bullard, 2020). Regarding federal laws, there is no current law explicitly prohibiting discrimination against LGBTQ students. Even though some interpretations of existing federal rights laws provide limited protections in school, I disagree with the current legal position in Louisiana because, without explicit state or federal protections against discrimination and bullying on the basis of sexual orientation and gender identity, LGBTQ students remain vulnerable.
